Penalties for Sexual Assault in Nevada

Following is a brief outline of the potential penalties for sexual assault (repeat offenders will face enhanced penalties):

  • If the victim is 16 or older and sustains substantial bodily harm – life in prison without the possibility of parole, or life in prison with the possibility of parole after 15 years.
  • If the victim is 16 or older and does not sustain substantial bodily harm – life in prison with the possibility of parole after 10 years.
  • If the victim is 15 or younger and sustains substantial bodily harm – life in prison without the possibility of parole.
  • If the victim is 14 or 15 and does not sustain substantial bodily harm – life in prison with the possibility of parole after 25 years.
  • If the victim is 13 or younger and does not sustain substantial bodily harm – life in prison with the possibility of parole after 35 years.

Nevada Revised Statutes Chapter 200, Section 366 (NRS 200.366) defines sexual assault and the penalties that may be enforced upon a defendant convicted of this crime. The general definition of sexual assault is forced or non-consensual sexual intercourse with another person. It may be committed against the will of the victim or in a situation where the victim was mentally or physically disabled and the offender knew or should have reasonably known of the disability or incapacity.
