Reports surfaced in this month that Kanye West was involved in an alleged batter at a Los Angeles chiropractor's office. Apparently, Kim Kardashian and Kanye were at the office when an 18-year-old began verbally assaulting Kardashian. Allegedly, Kanye was not with Kim during this time, but quickly came to her aid and a fight ensued, resulting in a battery on the man.
Attorneys for the alleged victim are saying that the young man is currently in negotiations to settle the battery dispute out of court and without criminal charges. Witnesses at the office building report that Kanye battered the man pretty severely, however reports indicate that the young man does not have any serious injuries.
Apparently the altercation began when the young man screamed racially biased comments at Kardashian, calling her a "n… lover" and other names. The verbal assault was the predecessor to the physical battery that ensued. Initial reports indicated that the young man was actually trying to protect Kardashian from a mob of reporters when the incident took place, however that is yet unconfirmed.
Assault and battery are criminal offenses that can be charged individually. Assault is typically charged where the individual is in immediate apprehension of an attack. Battery is charged where a person makes an unwanted contact with another person, causing harm but not necessarily causing any significant or permanent damage. Both charges are serious violent crimes and can result in long jail terms depending on the circumstances of the case and the alleged victim. Potential defenses include defense of others and self-defense and having an experienced attorney on your side will enable you to explore these defense options.
If you, or someone you know, has been charged with assault or battery it is important to have a criminal defense attorney on your side to help you with the specific facts and circumstances of your case. Not all battery charges can be addressed in a civil settlement, as it appears is the end-game here for Kanye West and Kim Kardashian.
