Activist Erin Brockovich was arrested earlier this month for Operating under the Influence (OUI). Brockovich, who was made famous by Julia Roberts portrayal of her as the title character in the movie, was arrested after she was observed having difficulty driving a boat on Lake Mead, which is located near Henderson, Nevada. According to reports, Brockovich had an argument with her husband while they were out boating and slapped her husband. A game warden who saw the dispute asked Brockovich to dock the boat. Brockovich had trouble docking the vehicle and the game warden subsequently noticed that Brockovich appeared intoxicated. Brockovich later failed a test which showed that her blood alcohol level was over the legal limit. To date, it does not appear that Brockovich has been arrested or charged with Battery Domestic Violence.
When people think of Driving or Operating under the Influence, they ordinarily think of cars, trucks and motorcycles. Many people are not even aware that Driving under the Influence laws also apply to boats and other motorized vehicles until they have already been arrested and/or charged with OUI. In Nevada, Driving under the Influence (DUI) is a serious offense. Penalties for DUI and OUI can include up to six (6) months in jail, huge fines, extensive counseling and community service.
Battery Domestic Violence charges are also taken very seriously in Nevada. When most people think about Battery Domestic Violence, they think of a domineering spouse threatening, beating and intimidating the other spouse into dependence and compliance. But, in Nevada, a simple unwanted poke, prod, pinch or touch is considered Domestic Violence.
