Former "Prison Break" star Lane Garrison was arrested April 22, 2012 when his girlfriend accused him of hitting her. Garrison was on parole for Vehicular Manslaughter when the incident occurred. After serving more than two (2) months in jail in connection with the Battery Domestic Violence charge as well as a related hold for Parole Violation, Garrison was finally released on $50,000 bail. It has been reported that the alleged Domestic Battery was captured on security video and that the video shows Garrison punching the alleged victim. An objective review of the video indicates that an altercation occurred, but the video is not the indisputable evidence that it has been reported to be.
Battery Domestic Violence cases are frequently "He Said-She Said" cases, meaning that there are rarely witnesses or physical evidence of what happened during a particular altercation. In many cases, Police incorrectly assume that just because an argument happened and one of the people present has an injury, that a Domestic Violence incident must have occurred. In other cases, Police assume the woman (or the person with the more serious injury) is the victim, when in reality that is not the case.
If the accused person is on Probation or Parole at the time of the alleged Battery Domestic Violence incident, the person may also be arrested on a Probation Violation or Parole Violation. The United States Constitution provides that criminal defendants are entitled to reasonable bail in virtually all cases. One of the few exceptions to that rule is Probation or Parole Violations. That means that, in some cases, a person arrested on a probation or parole violation may be held without bail – even if the allegation hasn't been proven yet.
